Proposal: A continuation of a 12-lot Major Subdivision consisting of new lots ranging in size from 6,829 sq. ft., to 9,234 sq. ft. The original hearing was held on September 29, 2021, and the Hearings Officer ordered the record remain open for new evidence. The applicant submitted an approved wetland delineation from the Department of State Lands (DSL), showing a very small 0.03-acre wetland area in the southwest corner of the subject property. The applicant then requested the 120-day clock be extended for 90 days, and that the hearings officer (HO) decision be postponed until the applicant could address ZDO Sec. 709, the Water Quality Resource Area (WQRA). The applicant has prepared a detailed environmental assessment challenging the applicability of ZDO Sec. 709, and is requesting the HO consider this with the aforementioned subdivision request. Therefore, a new hearing is required to address ZDO Sec. 709. Staff will prepare a memorandum and response based on the applicant’s submitted environmental assessment, which will be ready no later than 7 days prior to the hearing
