Minor and Time-Sensitive Comprehensive Plan and ZDO Amendments is a Planning project that is intended to be completed annually and focuses on changes to the County’s Comprehensive Plan and Zoning and Development Ordinance (ZDO) to comply with any new state and federal mandates, clarify existing language, correct errors, or adopt optional provisions that require only minimal analysis. This year, however, this amendment package is also proposed as a vehicle for the adoption of new land use allowances in state law.

The 2023-2024 Minor and Time Sensitive Amendments and New Housing Options package, Ordinance ZDO-285, is a narrowly-focused package of amendments that primarily responds to certain land use legislation approved in the 2021, 2022 and 2023 Oregon legislative sessions and recent state rulemaking.

Comprehensive Plan map amendment to change the land use plan designation for the subject properties from Medium Density Residential (MDR) to Light Industrial (LI), with a corresponding zone change from Medium Density Residential (MR-1) to Light Industrial (LI) to allow for future development of light industrial uses. No development is proposed with this application.

File number Z0315-23-CP is a request for a Comprehensive Plan Map amendment to change the Willamette River Greenway designation from “Limited Use” to “Multiple Use” for a portion of river abutting the subject property to allow for construction of a new private noncommercial dock. File number Z0316-23-R is a corresponding Willamette River Greenway dock application for approval to construct a private noncommercial dock.

ZDO-286 is a package of legislative amendments to the Comprehensive Plan and Zoning and Development Ordinance to provide a procedural framework for considering the adoption of local public park master plans in the EFU, TBR and AG/F zoning districts. These amendments ensure consistency with Oregon Administrative Rules for local public parks, and also makes minor housekeeping edits.

The County is presently the defendant in a federal lawsuit alleging that the ZDO does not treat places of worship equally with other similarly situated uses. The County has denied this allegation; however, to avoid future lawsuits and to assist with resolution of the present case, County Counsel has recommended that we make amendments to the ZDO.
